Fiedler Deutsch, LLP Settles Nursing Home – Bed Sore Case for $350,000

06/23/21

We were able to secure a $350,000 settlement for the estate of our deceased client who passed away after suffering bed sores at a local Westchester nursing home. The allegations in the case involved the failure to the nursing home to provide proper wound care for the decedent while she was a resident at their nursing home. Bedsores are ulcers that happen on areas of the skin that are under pressure from lying in bed, sitting in a wheelchair, or wearing a cast for a prolonged time. Bedsores are also called pressure injuries, pressure sores, pressure ulcers, or decubitus ulcers. Bedsores can be a serious problem among frail older adults. We alleged that the bed sores should not have occurred and once they did occur the nursing home failed to properly treat them permitting them to worsen. They eventually got infected which led to our client’s death.

Bedsores are a common sign of nursing home abuse and neglect. They are preventable when a nursing home or long term care center sticks to a schedule for turning the resident before the the buildup of too much pressure begins in any one area of the body. Failing to do so is an act of negligence and a violation of your rights as a nursing home resident under New York law. If your loved one has a bedsore, it may be a sign that the nursing home is not taking proper care of its residents and neglecting your loved one.
